Sarah P. Pozzi
Of Counsel
Sarah is a litigator. She enjoys advocating on behalf of clients involved in all forms of disputes. Her practice largely focuses on advising and defending insurance companies. Sarah is well-versed in navigating the complexities of coverage related to a variety of insurance policies and issues, including commercial general liability, personal lines property and auto policies, construction risks, different types of surplus lines coverages, and bad faith avoidance.
Although from Seattle originally, Sarah started her legal career in Portland, Oregon, where she practiced with an established civil defense and insurance coverage law firm. There, Sarah honed skills unique to Oregon practice while defending a variety of civil claims. She found particular interest in defending the professional malpractice claims of insurance agents and brokers under responding E&O policies.
Although Sarah happily maintains a strong Oregon practice, she has appreciated the opportunity to strengthen her Washington skills since moving back to Seattle in 2021. Specifically, Sarah has helped insurance companies navigate claims under the Washington Insurance Fair Conduct Act (IFCA) and Consumer Protection Act (CPA). She also assists in guiding insurers through the complexities of Washington-specific covenant judgment litigation.
When not combing through the nuances and idiosyncrasies of the insurance policy before her, Sarah is typically found roaming the foothills and ridgelines of the Cascades, along with her family’s blissfully headstrong little dog, Bitsy.
- Sarah represented a large, global insurance company in a multiparty lawsuit over coverage for claims related to per- and polyfluoroalkyls (PFAS) in Aqueous Film-Forming Foam. There, Sarah prepared and defended that insurer’s corporate designee witness on topics unique to underwriting commercial high-level excess insurance policies, including "emerging risk" considerations.
- Sarah’s representative work also includes advising a carrier on obligations under a primary-layer multinational insurance program issued to a U.S.-based turbomachinery manufacturer with global subsidiary operations. This work involved closely monitoring an underlying lawsuit over an explosion at one of Europe’s largest petrochemical steam-cracking plants, as well as extensive analysis of the program’s difference-in-conditions and difference-in-limits provisions.
- Sarah represented an insurance company client at trial in Portland, Oregon, within the context of a decade-long multiparty insurance contribution lawsuit under Oregon’s Environmental Cleanup Assistance Act (OECAA). During the trial, Sarah secured finality for her client by obtaining an order of dismissal from the lawsuit and purported lingering contribution cross-claims.
